All materials including but not limited to tests are presented in an "as is" condition and any warranties for fitness of purpose of merchantability are hereby expressly disclaimed.

All claims arising out of the use of this site shall be governed by the laws of Florida. Users of this test site hereby irrevocably submit to the jurisdiction of, and agree to initiate and prosecute any and all claims that may be brought against Kidtest.com, L.C. exclusively in the State and/or Unites States District Courts sitting in Ft. Myers, Florida and irrevocably waive any objection they may now or hereafter have as to the venue of suits or that such Courts are an inconvenient forum.

PRIVACY FOR PARENTS, OTHER ADULTS AND KIDS

Parents and Other Adults

Kidtest.com takes your concerns about privacy seriously. We intend to make every reasonable effort to protect you. Kidtest is also concerned about the safety and protection of children's personal information collected and used online (see privacy policy for children below).

When you communicate with us online or use any of our online services, we may add your e-mail address to our electronic mailing list so that, from time to time, we can send you information about new features, additions, and changes in our website.

In addition, we may from time to time provide your demographic information including your e-mail address to third parties that we determine provide or refer goods or services, which might be of interest to you.

When you order Kidtest.com products and services online, your credit card information is verified and used for order filling and processing your bill. If you would like to confirm the accuracy of any information that we may have collected from you, please write to info@kidtest.com.

Kidtest.com encourages parents to be involved with and aware of their children's online experience. Members under 13 years of age shouldn't submit or post information at Kidtest.com's web site or its Catalog Store web site without the consent of their parent or guardian.

Unless otherwise disclosed during collection, Kidtest.com does not provide any personally identifying information, regardless of its source, to any third party, for any purpose whatsoever from our members under 13 years of age except as expressly provided by this privacy policy. We don't use any information collected from visitors under 13 years of age for any marketing or promotional purposes whatsoever, either inside or outside Kidtest.com, except as we explicitly state during registration for contests and promotions. In that case, the information collected is used only for the specific contest or promotion.

When a child under age 13 registers with any of our sites, we request a minimum amount of information in order to process the registration including a first name, the last name, e-mail address and parent's e-mail address. All members receive an e-mail confirming their registration. We also send the child's parent or guardian an e-mail alerting them to the child's registration and giving them the chance to cancel the registration and ask the child's information be deleted from our records.

Members under age 13 do not have access to Kidtest.com's services or features that might collect personally identifiable information without prior verifiable parental consent. Therefore, children may participate in such activities upon registration, unless their parent or guardian asks that their registration be invalidated.

Although members under 13 years of age may be allowed to participate in some contests and promotions, if such a member wins, notification and prizes are sent to the parents or guardians identified in the initial registration process. Publication of contest winners names, ages, or images of individuals under 13 requires parental or guardian consent.

Kidtest.com does not require a child under 13 to disclose more information than is reasonably necessary to participate in a testing or learning activity as a condition of participation.

Kids Age 13 Through 17

Teens age 13-17 are required to provide the e-mail address of a parent or guardian when they register at our Kidtest.com web site. We then e-mail a notification message to the teen's parent or guardian that identifies the information supplied at registration.
